These Terms of Use ("Terms") govern your access to and use of the services provided by Red Apple Technologies ("Red Apple," "we," "us," or "our"). This includes our games, applications, websites, and associated services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference into these Terms.

If you do not agree with these Terms or our Privacy Policy, please do not use the Service. Use of the Service is prohibited where prohibited by local laws.

1. LICENSE GRANT AND LIMITATIONS

1.1 Grant of License

Subject to your compliance with these Terms and any additional policies or rules provided by Red Apple Technologies, we grant you a non-exclusive, non-transferable, revocable, limited license to access and use the Service for your personal, non-commercial entertainment. You agree not to use the Service for any other purpose.

1.2 Restrictions

You agree that you will not:

  • Access the Service if you are under 18 years of age or the legal gaming age in your jurisdiction.
  • Use the Service if you have been previously banned by Red Apple Technologies.
  • Utilize the Service for commercial purposes or to distribute unsolicited communications.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service, or interfere with others' use.
  • Attempt to gain unauthorized access to any part of the Service, its servers, or related databases.
  • Use unauthorized software or exploits to modify or interfere with the Service.
  • Engage in any behavior that could disrupt or harm the Service or other users.

2. ACCOUNT SUSPENSION AND TERMINATION

2.1 Suspension and Termination

Red Apple Technologies reserves the right to limit, suspend, or terminate your access to the Service if you fail to comply with these Terms or if we suspect any misuse or illegal activity. We may also take action to address risks, legal liabilities, or violations of intellectual property rights.

3. OWNERSHIP AND INTELLECTUAL PROPERTY

3.1 Intellectual Property

All intellectual property rights in the Service, including but not limited to software, graphics, and content, are owned by or licensed to Red Apple Technologies. You may not reproduce, modify, or use any part of the Service without our express written consent.

3.2 User Content

By submitting any content through the Service, you grant Red Apple Technologies a worldwide, royalty-free, perpetual, and transferable license to use, display, and distribute that content. You are responsible for ensuring your content does not infringe on the rights of others and complies with all applicable laws.

4. USER CONTENT AND INTERACTIONS

4.1 Content Screening

Red Apple Technologies does not pre-screen all User Content and is not responsible for monitoring or editing it. We may review, remove, or refuse any User Content at our discretion.

4.2 Interactions with Others

You are responsible for your interactions with other users and third parties through the Service. Red Apple Technologies is not liable for any disputes or damages arising from such interactions.

5. COMPLIANCE WITH THE ONLINE GAMING BILL, 2025

To comply with the Promotion and Regulation of Online Gaming Act, 2025:

  • No Real-Money Gaming: The Service does not support, promote, or facilitate real-money gaming, wagering, or gambling of any kind.
  • Permissible Games Only: We offer e-sports, casual, social and skill-based games allowed under Indian law.
  • Age Verification: Mandatory age and identity verification processes are enforced to safeguard minors.
  • Data Protection: All user data is collected, processed, and stored in compliance with applicable data protection and IT security laws.
  • Advertising Restrictions: We do not advertise or promote any real-money gaming activities.
  • Government Cooperation: Red Apple Technologies will cooperate with authorized officers or regulators for inspections and enforcement as required by law.

6. UPDATES AND CHANGES

The Service is continuously evolving, and Red Apple Technologies may require you to accept updates to maintain access. We may update the Service with or without notice to you.

7. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available." Red Apple Technologies makes no warranties regarding the availability, reliability, or performance of the Service.

8. LIMITATION OF LIABILITY

Red Apple Technologies is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our liability is limited to the amount you have paid to us in the six months preceding any claim.

9. INDEMNIFICATION

You agree to indemnify Red Apple Technologies from any claims, damages, or losses arising from your use of the Service or breach of these Terms.

10. THIRD-PARTY LINKS

The Service may contain links to third-party websites. Red Apple Technologies is not responsible for the content or practices of these external sites.

11. DISPUTE RESOLUTION

Disputes will be governed by the laws of India and subject to directives of the National Online Gaming Authority (NOGA) and the Online Gaming Appellate Tribunal where applicable.

12. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, it will be enforced to the extent possible, and the remaining provisions will continue in full force.

13. GENERAL PROVISIONS

  • Assignment: Red Apple Technologies may assign these Terms without your consent. You may not assign rights without written consent.
  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the full agreement.
  • No Waiver: Failure to enforce any provision does not waive rights.
  • Notices: Notices will be communicated via our website or provided contacts.
  • Equitable Remedies: Red Apple Technologies may seek equitable relief for any breach.
  • Force Majeure: Not liable for delays or failures caused by events beyond reasonable control.
